Dear PAO,
What can we do if an employer refuses to give the 13th month pay of their employees? My stepbrother has been working for a private company for two years already. Their company informed them that they would be getting a portion of their 13th month salary for this year, about a half of it, while some of them would be getting no 13th month pay at all because, according to their company, they are exempted from the 13th-Month Pay Law. Is this possible? Are there really employers who are exempted from giving 13th month pay to their employees?
