THE Sandiganbayan acquitted former Makati mayor Elenita Binay of graft in connection with the procurement of hospital beds and bedside cabinets for the Ospital ng Makati in 2001.

In a decision promulgated on Thursday, the court acquitted Binay, Ernesto Aspillaga, Dulce Cruz, and Luz Yamane-Garcia of the charge of violation of Section 3(e) of the Anti-Graft and Corrupt Practices Act "for failure of the prosecution to prove their guilt beyond reasonable doubt."

The court said that "there is no clear evidence to show that the accused-[then]members of the Committee on Awards disregarded the rules on procurement by relying on the recommendations of the Committee on Canvass."

In another case discussed in the same decision, the court likewise acquitted Binay, Aspillaga, Cruz, and Yamane-Garcia of the charge of violation of Section 3(e) of the anti-graft law in connection with the procurement of electronic dry heat autoclave sterilizers and auto dry heat sterilizers in 2000.

However, the court found Conrado Pamintuan and Jaime Delos Reyes guilty beyond reasonable doubt of graft. In both cases and sentenced each of them to a minimum of six years and a month and a maximum of eight years-with perpetual disqualification to hold public office.
