Donna obtained a loan from me, and we executed a contract with mortgage. The contract was notarized, and Donna gave me her certificate of title. Donna's refusal to pay led me to the idea of foreclosing the mortgage. However, she denied the existence of the mortgage and claimed that there was a problem in the notarization of the contract which affected its validity. Further, she claimed that the mortgage did not appear in the notarial register and the notarial details in the contract were different from the entries in the notarial register. Will Donna's allegations suffice to invalidate the mortgage contract?
