Dear PAO,

I recently saw a video wherein a picture of a national candidate was placed on a Philippine flag while being waived in the crowd. I also learned that it was the organizers of the political rally who actually made and distributed the Philippine Flag containing the picture of their candidates. Is there a law against this kind of use of the Philippine flag? Also, is there a penalty imposed for its improper use? We hope your office can enlighten us on what the law says about this.

Dear Max,

Republic Act (RA) 8491, known as the "Flag and Heraldic Code of the Philippines" prescribes the proper use of the Philippine flag, among others. This law contains provisions that specify the design of the Philippine flag and the proper manner of its display and use as part of what are considered as heraldic items and devices that are intended to manifest national virtues and inculcate a just pride in our native land, fitting respect and affection for the national flag. (Sec. 2, Ibid.) Also stated under this law are the enumerations of prohibited acts with regard to its use.
