THE municipality of Sugpon, province of Ilocos Sur has won a land dispute case against the municipality of Bakun, Province of Benguet over a 1,117.20-hectare land located within their boundaries.

This happened after the Supreme Court denied for lack of merit the petition of the municipality of Bakun's through a decision penned by Justice Mario Lopez of the court's Third Division.

The Bakun town assailed the decision dated Feb. 1, 2018 and the resolution dated July 6, 2018 of the Court of Appeals which in turn affirmed in toto the resolutions of the local court in Ilocos Sur.

The high court sided with the RTC which are supported by the evidence on record including the administrative map of Benguet showing that the disputed area was beyond its territorial area.

It was also corroborated by other documentary evidence, among others, such as Land Classification Map 3441 and 1298 showing that the disputed areas are within Sugpon's territory.

In junking Bakun's petition, the high tribunal held that it "simply failed to show, by preponderant evidence, that the conflicted areas are located within the new boundary line."

According to the Court, the pieces of evidence presented by the Bakun town "exercised some acts of dominion over the property, but do not prove that the modified boundary line covers the disputed areas."

Concurring with the ruling were Associate Justices Marvic Leonen, Amy Lazaro-Javier, Jhosep Lopez and Anthonio Kho Jr.
